After a long gestation, we finally have the trade mark approval process ready for use. The policy can be found here:

anyone of you - and many are - who are using the word FHIR or the flame icon beyond fair use provisions are now required to formally apply for permission for your use.

we intend to grant approval to any organization that meets 2 criteria:
- the usage of the name FHIR differentiates it from "the FHIR specification' (e.g. no misleading claims about ownership of the name)
- there is a coherent plan for ensuring conformance/consistency with the specification

so what would we do with the myriad various like what I've started to use "Devices on FHIR" to reference the use of FHIR for healthcare device informatics and integration? Tethered to the HL7 DEV WG and the standardized device informatics community ... by extension (e.g., IHE PCD, IEEE, etc.)

Uses associated with the execution of official HL7 projects are HL7 processes, those of the trademark owner, and therefore permission is not required for them

IHE IEEE, etc will need to go through the formality of this process, but we will have to have some discussion about the granularity of the process for them.

The same applies to formal affiliate processes too, btw. Events or Projects of the affiliate (defined as those the affiliate can demonstrate governance over, and, for projects, can claim that they have an 'approved id' ) do not need trademark approval
